Review the Community Guidelines for HACC’s Official Social Media Accounts

Preamble:

HACC, Central Pennsylvania’s Community College, encourages active discussion and the right of its employees and students to share information and thoughts in alignment with the principles of free speech. HACC:

  • Expects users to:
    • Communicate with courtesy and respect
    • Be tolerant towards others’ viewpoints
    • Disagree respectfully if and when opinions do not align
  • Does not support or tolerate hatred and will vigorously oppose and remove information that attempts to threaten or oppress fellow members of our community

The following policy establishes the expectations of HACC social media accounts, students and employees in accordance with social media terms of service, Pennsylvania state law and federal law.

Definitions:

HACC social media accounts refer to any account administered by HACC employees on behalf of the College.

Freedom of Speech and Content Removal Policy:

HACC account administrators reserve the right to:

a.    Review all content, including (but not limited to) comments and posted materials, on official HACC social media accounts

b.    Remove content that violates Pennsylvania state law, federal law, HACC policy or the rules and regulations of the applicable host site 

Social media information qualifying for immediate removal includes (but is not limited to) content containing any of the following:

  • Speech that is not constitutionally protected by free speech, including:
    • Direct threats of physical harm to another, threats of violence or words inciting violence
    • Obscenity, pornography or sexually explicit/sexually vulgar language and profanity
      • According to Miller v. California, the standards to define obscenity are: “(a) whether "the average person, applying contemporary community standards" would find that the work, taken as a whole, appeals to the prurient interest, (b) whether the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by the applicable state law, and (c) whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value.”
    • Slander and libel
  • Speech that qualifies as harassment or discrimination under HACC policy, Pennsylvania law or federal law, including Title IX
  • Speech that promotes illegal activity under HACC policy, Pennsylvania law or federal law
  • Product advertisements and other commercial promotion or solicitation
  • Spam
  • Political endorsements
  • Content that violates the copyright, trademark or intellectual property rights of the College
  • Comments that otherwise violate the law, HACC policy or the rules and regulations of the applicable host site

Violations:

HACC reserves the right to review content posted to any HACC official social media site or webpage. HACC account administrators may take action to report, block or ban users from HACC social media accounts who violate the policy outlined above.

College employees who violate this policy may be subject to disciplinary measures up to and including suspension, dismissal and termination. Students who violate this policy may be subject to discipline in accordance with the Student Code of Conduct.

Privacy:

HACC will not require a current or prospective employee or student to disclose their personal social media accounts, nor will HACC require a current or prospective employee or student to provide or disclose a user name or password or provide the College access to a personal social media account, except as otherwise required by state or federal law.
